There is no question that re-opening the FBI Investigation into Hillary Clinton’s email server is a big deal. The FBI normally avoids acting just before an election in order to avoid charges of political manipulation. NBC reports:
The FBI is reviewing a new batch of Hillary Clinton emails, bureau director James Comey said in a letter to the Senate Judiciary Committee on Friday.
"In connection with an unrelated case, the FBI has learned of the existence of emails that appear to be pertinent to the investigation … I agreed that the FBI should take appropriate investigative steps designed to allow investigators to review these emails to determine whether they contain classified information, as well as to assess their importance to our investigation," he wrote.
The very first thing to note is that Comey made no mention of a grand jury. The emails whose existence he learned of may have been the result of a subpoena in another investigation. Update: It was announced ten days ago that grand jury would be convened to investigate Weiner's sexting "by the end of the month." The timing of Comey's letter strongly suggests that the devices containing new emails were obtained through a grand jury subpoena, with no immunity deals or evidence destruction needed. If that is the case, further subpoenas are quite possible, a tool that was left unused in the investigation to date.
There are 3 competing theories as to why he might be doing this now that come to mind.

Democratic presidential candidate Hillary Clinton called on the FBI Friday to release all information in its renewed investigation into her use of a private server while secretary of state after discovering new emails – apparently during the probe of former Rep. Anthony Weiner’s sexting – in a stunning turn of events just days before the presidential election.
"[FBI Director James Comey] himself has said he doesn’t know whether the emails ... are significant or not," Clinton told reporters in Iowa Friday evening. "I’m confident whatever they are will not change the conclusion reached in July. Therefore it’s imperative that the bureau explain this issue in question, whatever it is, without any delay."
Earlier Friday, Comey informed top members of Congress in a letter that the bureau had “learned of the existence of emails that appear to be pertinent to the investigation.”
Comey did not detail those emails, saying only that they surfaced “in connection with an unrelated case.”

Gohmert explains why Comey had to notify Congress

While many Democrats publicly fume at FBI Director James Comey and many Republicans sense political opportunity, a member of the U.S. House Judiciary Committee tells WND and Radio America the letter was really Comey’s way of avoiding a perjury investigation against him in Congress.
On Friday, Comey sent a letter to several committee and subcommittee chairman and ranking members, informing them that new emails “pertinent to the investigation” had been discovered. Twice in the three-paragraph letter, Comey noted his duty to keep Congress up to speed on the case.
“Although the FBI cannot yet assess whether or not this material may be significant, and I cannot predict how long it will take us to complete this additional work, I believe it is important to update your Committees about our efforts in light of my previous testimony,” Comey stated.
Rep. Louie Gohmert, R-Texas, said this really boils down to Comey keeping his sworn promise to lawmakers given during testimony in the wake of the FBI refusing to recommend charges against Hillary Clinton.
“It is actually the director of the FBI avoiding lying to Congress. He said he would update us,” Gohmert told WND and Radio America. “I think at the time he said it, he probably did not anticipate that there was going to be any other developments sufficient to get him to pursue the case further.”

Team Clinton put James Comey in an ugly situation and then blamed him for it.
The word of the weekend was “protocol.”
In deciding to tell Congress about a new trove of e-mails that may or may not contain classified information and may or may not relate to Hillary Clinton, FBI director James Comey broke Justice Department protocol both by releasing information close to an election and by revealing details of an ongoing investigation. It was a “stunning breach of protocol,” former attorney general Eric Holder dutifully insisted.
Tim Kaine invoked protocol more than a half-dozen times Sunday in his interview with ABC’s George Stephanopoulos. “It is just extremely puzzling,” the Democratic vice-presidential nominee said. “Why would you break these two protocols?”
“Puzzled” was the runner-up word of the weekend; Kaine used it repeatedly, as did Clinton’s campaign manager Robby Mook. “We are so puzzled right now,” Mook told NBC’s Chuck Todd.
Well, let’s try to solve this riddle. Comey’s regrettable decision is much easier to understand once you realize it is one small piece of the larger puzzle. He made a bad choice — though probably the least bad choice of those available to him — precisely because all of the relevant actors in this sordid mess have been breaking protocol for years.
Clinton broke all kinds of protocol by setting up her stealth server and then lying about it not only in public but also, I would argue, to Congress. She broke protocol when her aides smashed phones with a hammer and erased e-mails — official government records — after they were subject to a congressional subpoena.

This Is Not James Comey’s Fault, Democrats

Judging by Democrats’ reactions, you’d think James Comey had endangered classified national-security information or something.
“Apocalyptic” is the only adequate description of the Left’s reaction to Comey’s recent letter to Congress announcing new information in the Hillary Clinton e-mail investigation. As letters go, it was light on detail, as Democrats have been quick to point out, though it would seem to be putting one’s nongendered garment over one’s head to suggest that it is a threat not just to Clinton’s chances at the ballot box on Tuesday, but to the survival of American democracy itself.
Yet that is just what several left-leaning politicos and commentators have suggested, from Harry Reid’s insinuating that Comey’s letter may have broken the law, to Michael Tomasky’s arguing that “this is shaping up to be a Third-World election” and that perhaps the Organization of American States should intervene. Tomasky even went so far as to hint that Iran — yes, Iran — is doing more to protect its electoral integrity than we are.
In July, the same James Comey contorted himself into rhetorical pretzels to avoid recommending Hillary Clinton be prosecuted for exposing classified information, despite laying out a compelling case that she would be facing serious charges were she possessed of any surname besides the one she has. He settled on saying that while she was “extremely reckless,” her actions did not constitute “gross negligence,” a distinction that remains unclear.
Democrats were miffed that Comey had the audacity to go even that far, but, all in all, he was praised as a fine public servant. As my colleague Andy McCarthy has explained at length, Comey’s press conference was an extravagant departure from Justice Department protocol, but Democrats were more than comfortable pardoning Comey’s excesses then, since he had acted in the service of helpful ends. He just wanted to “stay out” of the election, they explained.
But now? Following another departure from DOJ protocol, Democrats are incensed about the threat Comey’s letter poses to the foundations of our key institutions, and to our democratic (or was it Democratic?) government! On the matter of whether he himself is a bitter GOP partisan or simply “appeasing [Republican] bullies” (E. J. Dionne), opinions vary. But that he’s done something shockingly irresponsible, Democrats have no doubt. When Comey went rogue in July, he was just leaving the race up to We the People. But when he went rogue in October, he “put his thumb on the scales.”

FBI clears Clinton in email review two days before election
The FBI said on Sunday it still believed no charges were warranted against Democrat Hillary Clinton after finishing its review of newly discovered emails related to her private server, lifting a cloud over her presidential campaign two days before the U.S. election.
FBI Director James Comey made the announcement in a letter to Congress on Sunday, saying the agency had not changed its conclusions from July that no criminal charges were warranted against Clinton for her use of a private email server for government work.
"The FBI investigative team has been working around the clock to process and review a large volume of emails from a device obtained in connection with an unrelated criminal investigation," Comey said in the letter.

Two days before the election, FBI director James Comey confirmed that a trove of newly discovered emails related to Hillary Clinton did not reveal any evidence warranting a reversal of the Bureau’s previous decision not to indict the Democratic candidate.
After working “around the clock to process and review a large number of emails” in order to resolve the question before Election Day, Comey wrote in a letter to Congress, “Based on our review, we have not changed our conclusions that we expressed in July.”
Clinton was first cleared by Comey of wrongdoing in her handling of private email servers while serving as secretary of state four months ago. In his verdict, Comey said that while Clinton had been “extremely careless”, any transgressions had been unintentional.
While her opponents disagreed with the FBI’s decision and continued to point to the email investigation as evidence of Clinton’s dishonesty, the hype around it had largely died down by the time Comey sent a letter to Congress on October 30 announcing that the FBI had uncovered possible connections to Clinton during a review of emails related to an investigation into Anthony Weiner’s sexting scandal.
